What are the tasks of a data protection officer?

The tasks of the data protection officer in a company are clearly defined by the GDPR. The data protection officer ensures compliance with the regulations when handling personal data in the company.

  • Transparent design of data processing processes in the company
  • Analysis of process flows
  • Analysis of technical devices with regard to GDPR-compliant data storage
  • Documentation of data protection
  • Checking whether the guidelines are being adhered to
  • Contact person in the company for data protection issues
  • Training of employees

The General Data Protection Regulation is a regulation that came into force on May 25, 2018. This regulation must be implemented and applied immediately by all member states of the European Union. The aim of the GDPR is to standardize data protection in the European Union and to strengthen the rights of the data subjects whose data is processed.

The GDPR is not an absolute harmonization, as 69 opening clauses give the member states regulatory leeway. However, the GDPR cannot be weakened or repealed with a passage. The opening clauses serve to implement stricter national rules.

Data protection is important because the protection of personal data is a fundamental right. Everyone has the right to have their data, which they have disclosed in order to provide a service, protected and not distributed. It does not matter whether these activities are on the Internet or in the real world at the doctor, physiotherapist or retailer around the corner. With the introduction of the GDPR, the European General Data Protection Regulation, on May 25, 2018, the protection of personal data has a direct impact on the organization of every company in all sectors.

In general, the costs for an external data protection officer depend on the scope and size of the company. Choosing an external data protection officer over an internally appointed one will ultimately be the cheaper solution for your company.

The price for implementing data protection in your company depends essentially on the following factors:

  • Number of employees
  • Number of processes in the company
  • Description of the technical and organizational measures – TOMs
  • Number of software used in the company
  • Number of contract data processors
  • Preparation of data protection impact assessments
  • Training of employees
  • Contact person for employees
  • Contact person for those affected
  • Contact person for supervisory authorities

A data protection officer must be appointed if at least 20 people in a company or association are involved in the processing of personal data. The data protection officer must be named to the relevant authority.

The following points should be taken into account when implementing the GDPR in a company:

Description of the processes in which personal data is processed.

  1. Creation of AV contracts (order processing contracts)
  2. Creation of TOMs (technical and organizational measures)
  3. Establishment of the data protection policy
  4. Employee audits
